The MTA, which runs New York City’s vast subway and bus system, filed its lawsuit in the Southern District of New York federal court hours after the Transportation Department announced that it was rescinding the pilot program. The agency alleges that Duffy and other federal officials violated multiple federal procedure laws, including Fifth Amendment rights to due process. The MTA’s attorneys asked the court to stop the termination of the program.

“It’s mystifying that after four years and 4,000 pages of federally-supervised environmental review — and barely three months after giving final approval to the Congestion Relief Program — USDOT would seek to totally reverse course,” MTA chair and CEO Janno Lieber wrote.

New York Gov. Kathy Hochul (D) criticized the administration’s move, writing in a statement on X that congestion pricing has helped shorten commutes, increase foot traffic to businesses and increase taxi trips. She warned Trump that “we’ll see you in court.”

Eric A. Goldstein, a senior attorney at the Natural Resources Defense Council who has worked on this issue for more than a decade, said the Transportation Department “has a heavy burden to convince a court that its 180-degree reversal of its previous position approving congestion pricing is based on new factual information and not simply a change in administrations.”
