I think the fund will be ruled invalid (per the Judge wondering how this fund was set up legally), like I've never heard of the IRS paying off someone when a tax return was revealed (and it shouldn't have been). In that case, it doesn't matter, you still owe any tax, etc. payable to the IRS.
