8. This wouldn't be unprecedented for elderly non violent criminals.

It's not so much because of mercy as it is about medical expenses of the elderly. Prisons have to accommodate everything from medical treatments to special care. Much of that require loading the prisoner up and taking them to a clinic on a regular basis.

I often joke that with my medical issues I would be immune from a lot of crimes. Home detention would be the worst they'd give me, and I do that a lot myself anyway.
