given that both men admitted to having sex with the girl - and the girl presumably recalls nothing. I assume that the presumption is that she agreed to have sex with McDonald, but not with Evans . . . but if she can't remember anything, how does she know she agreed to have sex with McDonald?

Seems like it should have been both or neither.

Very strange decision by this court.
