4. In this case it seems 1st Amendment protection, freedom of speech, outweighs private property rights

At least in the court's thinking. Then there's whistleblower laws. Most states have them, but they vary widely. The thinking goes that exposing wrong doing, certainly illegal activities, outweighs someone's right to privacy.
