If the school board chooses to flout (ignore) the law ...
that puts them in approximately the same category (and ethical position?) as the 'constitutional sheriffs' - or the county clerk refusing to hand out marriage licenses .. ?

and I have no sympathies for those nutjobs at all !

and 2) if a principled 'protest' against injustice leads you into breaking/abridging the law - then accept that there are (at least potentially) corresponding consequence attached to your principled action.
(which it sounds like both board and this person has done)
