One effect of Roe and Casey was that these progressive decisions allowed lawmakers to escape the task of actually updating their statutes, at least as far as reproductive choice and patient health are concerned.

Legislators were able to avoid whatever political consequences they might otherwise have faced for doing the actual job of modernizing their code books wherever the topic was historically referenced.

Dobbs now requires lawmakers to face a comeuppance of sorts for their previous lives of benign neglect.

Alito et al. probably think this is a "healthy" development.
