The law as written in the Constitution. For almost everything, applying a century's old document to a world that has changed enormously will lead them to different opinions.

Alito was confirmed knowing he was outside the mainstream with his view of what the relative powers of the President should be. However, for the majority, the Constitution itself gives the Congress a role here.
