Jack Smith to sit for House Judiciary deposition on Dec. 17

Former special counsel Jack Smith has agreed to sit for a deposition with the House Judiciary Committee on Dec. 17 after the panel's Republicans issued a subpoena compelling him to appear for closed-door questioning. ... The subpoena comes after Smith pushed to testify publicly about his prosecution of President Trump for his actions related to Jan. 6, 2021, and retaining classified documents at Mar-a-Lago.

"The Committee on the Judiciary is continuing to conduct oversight of the operations of the Office of Special Counsel you led--specifically, your team's prosecutions of President Donald J. Trump and his co-defendants. Due to your service as Special Counsel, the Committee believes that you possess information that is vital to its oversight of this matter," Chair Jim Jordan (R-Ohio) wrote on the subpoena. ... Smith's legal team said they were disappointed Republicans rejected his offer to testify publicly. .

"Nearly six weeks ago Jack offered to voluntarily appear before the House Judiciary committee in an open hearing to answer any questions lawmakers have about his investigation into President Trump's alleged efforts to unlawfully overturn the election results and retention of classified documents. We are disappointed that offer was rejected, and that the American people will be denied the opportunity to hear directly from Jack on these topics," attorney Peter Koski said in a statement. ... Rep. Jamie Raskin (D-Md.) said the rejection of Smith's offer to publicly testify will allow the GOP members of the panel to miscast the former special counsel's testimony.

In October, Smith told the panel he would prefer to testify publicly, as is customary for special counsels once they complete their investigation and submit their report. ... "Given the many mischaracterizations of Mr. Smith's investigation into President Trump's alleged mishandling of classified documents and role in attempting to overturn the results of the 2020 election, Mr. Smith respectfully requests the opportunity to testify in open hearings before the House and Senate Judiciary Committees," his attorneys wrote in a letter to Jordan.
