Delaware judge rules corporations can vote in some municipal elections
Corporations, trusts and other “artificial entities” have the right to vote in some state elections, according to a new ruling by a Delaware judge.
Delaware Superior Court Judge Craig Karsnitz issued the ruling Tuesday in response to a case involving the beach town of Fenwick Island. The lawsuit in question was filed by the American Civil Liberties Union in December 2025, which argued the town was violating “the Delaware Constitution by allowing non-human artificial entities–such as corporations and LLCs–to vote in municipal elections.”
“With over 2 million business entities incorporated in Delaware–roughly double the amount of actual people living in the state–the people of Delaware risk having their voices drowned out when towns like Fenwick Island allow corporate voting,” the ACLU wrote.
Reuters reports Karsnitz ruled that the town was not diluting human votes by allowing companies ​and other legal entities that own property to cast votes in municipal elections. The outlet notes that nonresidents have been permitted to vote in local elections in the town since it was incorporated in 1953.
