Everybody knows it. The evidence for this particular victim is probably quite strong and convincing, which is why they're hiding it. I would guess that it was discovered sometimes between the first drop and the second drop, with a desperate attempt to cleanse the files of the cross-references causing the delay between drops. Of course, the DOJ group tasked with this is a mix of incompetent and unwilling, and cross-references are notoriously difficult to eliminate, so here we are.
