(12,285 posts)If I was the JAG for a CG receiving an order from Trump or DoD to invade Greenland, I would give a written legal opinion that the order was illegal - listing all the reasons the order is illegal. (If I was the JAG for any combatant command, I would already have a draft of the opinion ready to go.) I would advise the CG that it was their duty to refuse the order, in writing, stating all the reasons the order is illegal. (I would have the refusal already drafted and ready to be dated and signed.) I would advise the CG that they would be subject to court-martial, when Trump leaves office (one way or the other) if they do not refuse the order and that the SCOTUS created presidential immunity would not protect them.
Finally, I would inform the CG that I had forwarded the legal opinion up the JAG technical chain and mailed a copy to myself in case it became necessary to prove that I had rendered the opinion in the future - at their court-martial or mine.
Surely, someone at DoD has warned Trump and Hegseth that orders to invade Greenland would likely be refused.
