Warning: The use or possession of marijuana remains unlawful under Federal law regardless of whether it has been legalized or decriminalized for medicinal or recreational purposes in the state where you reside.

That would cover any purchase from a licensed dealer. However, Florida allows its residents to sell firearms to each other without a background check as long as the buyer is not a "prohibited person" under state and Federal law. How the seller is supposed to know that is up in the air, since only Federal Firearms License holders (FFL dealers) have access to the NICS (National Instant Criminal Background Check System) database.
