The Texas Commission on Environmental Quality did not answer specific questions relating to Floodlights findings. Instead, a representative wrote that TCEQ only issues air permits that comply with applicable state and federal air permitting rules and regulations including applicable public participation requirements.

Taken together, the thousands of new generators identified by Floodlight are permitted to emit nearly 2,500 tons of nitrogen oxides into Texas communities every yearmore than triple the states newest coal-fired power plant. (Nitrogen oxides are highly toxic gases associated with severe respiratory illness and even premature death.)
More than half of the data centers identified by Floodlight provided regulators with annual nitrogen oxide emission estimates that were just shy of thresholds that would require public input and more detailed environmental reviews.

Nitric oxide and nitrous oxide are oxides of nitrogen. Nitrogen is a chemical element with the atomic number 7, and it is a nonmetal in the p block of the periodic table of elements. Nitrogen in its different oxides has different oxidation states. Oxidation state is the number of electrons a particular atom can lose, gain or share with another atom. In nitric oxide, nitrogen atom shares two electrons with an oxygen atom. Hence, the oxidation state of nitrogen in nitric oxide is +2. In contrast, the oxidation state of nitrogen in nitrous oxide is +1. This is the main difference between nitric oxide and nitrous oxide. (more)
