The fatal flaw with indicting Trump in either case is that every crime being suggested requires proof beyond a reasonable doubt of some special mental state, such as intent, knowledge, or belief. Which will be next to impossible to prove.

Or is it just that they can't be used against republicans?

Actions prove intent!

You don't do certain things unless your intent is illegal.

Normal people don't spend weeks whining about a rigged election after they lose. They don't file idiotic lawsuits challenging the election with zero evidence to back them up. They don't call states threatening election officials to change the results. They don't gin up dozens of fake electors in key states to make an illegal end run around the Electoral college. They don't plot and carry out an insurrection.

People with illegal intent, namely to overthrow the government, do those things.

Even a third-tier law school grad fresh off his bar exam could prove intent when the ACTIONS these fascist seditionists committed so blatantly reveal it.
