No additional jail time for Trump supporters who brought guns near the 2020 Philly vote count

Two Virginia men who were convicted of carrying guns near the Convention Center as votes from the presidential election were being counted in 2020 were given sentences Wednesday that spared them from additional jail time.

Joshua Macias and Antonio Lamotta were each sentenced to 11½ to 23 months behind bars but placed on immediate parole followed by at least two years of probation.

Common Pleas Court Judge Lucretia Clemons did not explain her reasoning but emphasized that the men are now barred from possessing guns and said she would reevaluate her decision if there was any evidence of their being near a firearm.

Prosecutors had asked Clemons to impose a sentence of at least three years in prison. The men’s attorneys, meanwhile, said that incarceration was unnecessary and that their clients were being improperly villainized for their support of former President Donald Trump.

These were the guys who drove up here to Philly from VA in a hummer and parked near the Convention Center where the counting was going on.



I have seen 3 different versions of this story's final court outcome and apparently the above is a combo of them.

I.e., these guys were sentenced to 11 - 23 months in prison for 3rd degree felony and to probation for the misdemeanor charges but the judge actually ordered "immediate parole" for the prison sentence and have them on 2 years probation. They did serve some minimal time for this previously but were otherwise out on bail and they have since been charged for J6 involvement so not sure where that case is.

I think she was thinking very "local" vs "national" and possibly with the assumption that since they didn't actually use the weapons nor did they get into the facility, they would get some leniency - at least with respect to state charges.

How the feds will treat them for involvement months after this incident related to their attendance in D.C. at the J6 insurrection, is a whole other issue.
