Harry Litman - A Bellwether Prosecution in Minnesota

Minnesota’s efforts to potentially bring charges against the federal agents who fatally shot Renee Good and Alex Pretti continue to be stymied by the DOJ’s unprecedented stonewalling and refusal to give state prosecutors access to federal evidence.

That struggle is now in federal court in Washington, D.C., where Minnesota has sued the federal government under the Administrative Procedure Act and the 10th Amendment to compel access to critical evidence, including Good’s car, shell casings, and officer statements that the DOJ has refused to provide.

But while we await the outcome of that lawsuit, Minnesota has now brought a case against an ICE agent that has the same structural complexities, but is cleaner, stronger, and simpler than the prospective prosecutions for the fatal shootings.

Hennepin County Attorney Mary Moriarty on Thursday announced a criminal complaint charging an ICE agent, Gregory Donnell Morgan Jr., with two felony counts of second-degree assault.
