Colorado Governor Jared Polis rejected President Donald Trumps declaration that he has granted former Mesa County Clerk Tina Peters a full pardon saying it 'is a matter for the courts to decide".
Peters, who was convicted in 2024 on multiple state chargesincluding attempting to influence a public servant and criminal impersonationremains incarcerated at La Vista Correctional Facility while her appeal proceeds.
In a post on X Thursday, Polis wrote that Peters was convicted by a jury of her peers, prosecuted by a Republican District Attorney, and found guilty of violating Colorado state laws, including criminal impersonation. No President has jurisdiction over state law nor the power to pardon a person for state convictions. This is a matter for the courts to decide, and we will abide by court orders.
Trumps announcement does not affect Peters state sentence, which can only be altered under Colorado law by the governor.

(12,407 posts)Her appeal is being processed. So, yeah she's a criminal that pedo Trump can't legally pardon. I mean, eventually, if the dancing Supremes decide to hear it, her appeal process may end. But even if the dancing Supremes say the pedo can pardon state criminals, the state has no reason to follow an illegal ruling by the Supremes to release her.
The US Constitution says he can only pardon offenses against the United States. The Dancing Supremes have to do a lot of tap dancing to turn that around to give their favorite pedo the power to reach into a state and overturn the state's criminal prosecution.
But you never know. With enough money you can buy anything and anybody you want thanks to capitalism. So maybe the Supremes again violate the US Constitution and let her escape her crimes. Since precedent is no longer a thing for the Supremes and the US now operates on the whims of demented fool, maybe she could get her pardon. You got to wonder who is paying for her. The pedo sells the pardons and she's not a rich person and even bad lawyers got to get paid. So who's paying for her?

To have a message valued, which is the ultimate point of message communication, it must be repeated for a minimum average of 15 times.
I am educated in communication science, one of my multiple degrees is an M.S. degree. Just to clarify why I'm so confident about this.

Just saying...because we Coloradans are getting screwed to the wall by a) the Trump administration not releasing allocated funding into Colorado, AND by b) the disgusting rise in healthcare premium costs - 19.2% this year. And here we are paying lots of federal taxes, and for what? Nothing.
Hmm...taxation without representation. That caused a big stir 300-odd years ago, didn't it?
I watched Polis on Magavision saying "We will abide by the courts." I was hoping he would say "NO FUCKING WAY." He sounded weak as water. Hope there's more spine there than came through on the boob toob. Left me wondering where is our Gov Newsom?

And spread the word.

(174,290 posts)Presidents cant pardon individuals convicted of state crimes. Whether Trump understands that isnt entirely clear.
Trumpâs pardon for Coloradoâs Tina Peters suffers from one fatal flaw: she was convicted under state law. Trump can't pardon state crimes.

How stupid is Donny Trump? www.ms.now/rachel-maddo...

Late Thursday, he did it anyway. The Associated Press reported:
President Donald Trump issued a symbolic pardon for Tina Peters on Thursday, but it alone wont free the former Colorado elections administrator who was convicted under state laws of orchestrating a data breach scheme driven by false claims of fraud in the 2020 presidential election.
.....In August, Trump threatened Colorado with harsh measures unless the state agreed to release Peters, who he claimed had been tortured by Crooked Colorado politicians. More recently, Trumps Federal Bureau of Prisons contacted the Colorado Department of Corrections, seeking to transfer Peters from a state prison to federal custody, but that didnt work, either.
Left with no other options, the president announced a pardon for Peters.
Except that wont work, either. Peters faced state prosecution over state crimes. She was tried and convicted in state court. She was sentenced by a state judge and sent to a state prison.
A federal pardon might make Trump feel better, but its also utterly irrelevant. As Colorado Attorney General Philip Weiser explained in a written statement, One of the most basic principles of our constitution is that states have independent sovereignty and manage our own criminal justice systems without interference from the federal government. The idea that a president could pardon someone tried and convicted in state court has no precedent in American law, would be an outrageous departure from what our constitution requires, and will not hold up.
The question, however, is whether Trump knows this.
Its possible that the president, desperate to assist an ally hes powerless to help, issued the pardon as a symbolic gesture, grudgingly aware of the fact that it will change nothing. Whats unclear, however, is whether Trump intended this to have some force of law as Peters attorney continues to work to get his client out of prison. Watch this space.

(613 posts)Florida-based attorney, Peter Ticktin, channels his best Lewis Carroll to take us into a fantasy-world of logic-bending nonsense in his elaborate plea to the President justifying both the pardon and the concept that he has the power to pardon people for state offenses--because (brace yourself,) "when we consider the United States, it's personal pronoun is "it" which exemplifies that it is one nation."
If you are in the mood for a little "Peters in Wonderland" you should read the full letter here:
https://coloradonewsline.com/wp-content/uploads/2025/12/Sup.-Cover-Letter-for-Application-for-Pardon-for-Tina-Peters.pdf
It even details her time in incarceration which will just make you want to cry a river for her until you remember the words Alligator Alcatraz. Yeah, ef these people....
But could the United States calling itself "it" instead of "him/her" be enough for the Supreme Joke of the United States to grant this--and only this one--President pardon power over any and all offences committed in the entire country regardless of jurisdiction?
You would have to say maybe...sadly. It doesn't seem to take much.
