MS NOW Host Asks State Attorney General If Cops Should Be 'Arresting' ICE Agents Using 'Excessive Force'

MS NOWs Eugene Daniels asked Minnesota Attorney General Keith Ellison if there is a reality where state police are arresting ICE officers for excessive force. Ellison joined MS NOWs The Weekend on Saturday and Daniels brought up Minneapolis Police Chief Brian OHara warning officers they will lose their jobs if they do not intervene if they see ICE going outside the law.
If unlawful force is being used by any law enforcement officer against any person in this city and one of our officers is there, absolutely, I expect them to intervene, or theyll be fired, he said when asked how police should respond to excessive force by federal agents.
What does that actually look like? I guess Im just having a hard time picturing, and I think a lot of people will have a hard time picturing what that looks like for a police officer to intervene in with federal, you know, immigration enforcement and what that would entail, what it would look like, Daniels said on Saturday after reading OHaras comment.
Ellison, who said ICE agents are already operating in the state, said:
Well, the chief of police is just bravely trying to maintain law and order. All hes doing is saying that in in Minnesota, and really around the country, all officers have a duty to lend medical assistance and to intervene when they see unlawful conduct. Thats not a new thing when it comes to policing. If an officer sees somebody, a colleague, take some money or something and then not put it in the evidence locker or sees somebody using excessive force, they have a duty and obligation to say, I cannot stand by and witness you engage in unlawful conduct.

They should be arrested by state/local police and held in jail for a bit. See how they like it.

(2,649 posts)1 - they are masked.
2 - They are in violation of the Posse Comitatus Act.
and
They frequently violate laws like speeding, they cause accidents, they leave minor children in jeapordy, they steal, they shoot people, and they violate some states' Castle Defense Laws...
The last would be a warning to ICE thugs - do not attempt to drag a person out of a car or go onto a person's property - ICE is unidentified and should be considered to be criminals. So a person who defends him or herself against ICE thugs would be in fear for their lives..

(21,410 posts)We have very strong state governments in this country. Our constitution is pretty explicit about that. It lists the powers of the federal government, not a terribly long list, and explicitly states everything else is up to the states. Including jurisdiction on nearly all violent criminal acts within their state borders. The Supremacy Clause gives feds immunity ONLY if acting within the scope of their official duties. Beating the shit out of people, particularly US citizens, and violating their civil rights isn't within those official duties.
If they break state laws in that regard, arrest and indict them. If the regime wants to fight that, OK, we'll see them in court. In the meantime, federal thugs get prosecuted under state law. And incarcerated in state lock ups. Oh, won't that be fun.
"But the feds will stop sending federal money!" Yeah, and they're not doing that already? Do you want us to simply lay down and let them tromp all over us? Oh, hell no.
Ever wonder why the Fugitive Slave Act failed miserably. That's because northern free states simply wouldn't have it. Sure, federal agents and others deputized for the purpose could attempt to enforce it in free states but they were hamstrung at every turn by state governments. And if they didn't like it, tough. Go pound sand. Filmore threatened federal invasion, but that was politically impossible and backed the hell off. Another blowhard, presidential failure. Southern states threatened secession over the lack of enforcement. If they want to do the same now...well...bye. You just saved us the trouble.
