Cannon temporarily blocks Trump special counsel report's release

U.S. District Court Judge Aileen Cannon temporarily blocked the Justice Department from releasing Special Counsel Jack Smiths report on President-elect Trumps two prosecutions, granting a request from his legal team.
The ruling from Cannon comes after Trumps two co-defendants in the Mar-a-Lago documents case asked her to bar the release of both sections of Smiths report, including that dealing with Trumps election interference case.
Its not clear the extent of Cannons purview over the case, as a prior ruling from her tossing the case has been appealed to the 11th Circuit Court of Appeals.
Cannon said her ruling blocking any transmittance of the report would remain in effect until three days after any appeals court ruling unless the 11th Circuit rules otherwise.
The Florida-based federal judge said the ruling would preserve the status quo and prevent irreparable harm.

(27,844 posts)She shouldn't... and it's important to note that she hasn't (this is a temporary order allowing her to get a response from the prosecution) but this is related to a special counsel final report and she previously ruled that he wasn't properly appointed to that role.
She should be overturned if she does make such a permanent order - but she has the power to do it.

Thats what is being done with these investigations and reports. WE the American taxpayer foot the good damn bill. The reports are stolen from us. We need to start suing. A LOT.

(2,506 posts)DOJ is part of the EXECUTIVE BRANCH. The Executive Branch is a separate, equal branch of government. The Judicial Branch has no authority over internal matters. The 11th Circuit has no jurisdiction and Cannon clearly has no jurisdiction over cases not in front of her.
Just hold a god damned prime time press conference, call her corruption out and release the damn report, Joe. JFC this has gotten way, way beyond ridiculous at this point.

"It is not clear... whether she has jurisdiction because earlier this year, she threw out the Mar-a-Lago documents case explaining that, from her reasoning, Jack Smith did not have constitutional authority to bring that prosecution under the appointments clause of the Constitution," she said.
"And so there is no basis here to block the report in part because it is not clear there is a case or controversy in front of her, but if there were, the argument that Trump is making that presidential immunity also precludes the release of the report is a stretch of the Supreme Court's ruling that a president cannot be prosecuted for acts having to do with his presidency while he is a sitting president."
Legal analyst Barbara McQuade, meanwhile, speculated that Cannon's move was simply to help Trump run out the clock until his inauguration on January 20th.
"I don't think she has any jurisdiction, but delay is the name of the game," she said. "If they can stop the clock until January 20th then the Department of Justice will be a Trump appointee and they will kill the whole thing. That's the goal here."
