Special counsel Jack Smith filed motions to drop all federal charges against President-elect Donald Trump regarding his mishandling of classified documents and his effort to overturn his 2020 presidential election in the lead-up to the deadly Jan. 6 attack on the U.S Capitol.
Trump was first indicted in June 2023 in a federal court in Miami on 37 felony counts related to mishandling classified documents that he took from the White House to his Florida home. They included willful retention of national defense information, making false statements, and conspiracy to obstruct justice. A Florida judge dismissed the case, but Smiths office had sought an appeal.
Trump was separately indicted on four felonies in August 2023 for his attempt to reverse the 2020 election results: conspiracy to defraud the United States, conspiracy to obstruct an official proceeding, obstruction of and attempt to obstruct an official proceeding and conspiracy against rights. The case was then put on hold for months as Trumps team argued that the case should be thrown out for multiple reasons, including that a former president cannot be prosecuted for his actions in office.
Trump has claimed that the prosecutions were politically motivated. He has never publicly conceded that his election claims were, in fact, false, and he pleaded not guilty in both federal cases. The federal indictments of Trump marked an extraordinary moment in American history the first-ever accusation that a president sought illegally to cling to power, mishandled classified information and attempted to obstruct a federal investigation. Their dismissal also marks a historic moment. Fifty years after lawmakers from both parties forced Richard Nixon to resign the presidency amid allegations of criminal conduct in office, half of American voters chose to return Trump to the presidency.

The case was then put on hold for months as Trump's team argued that Trump could not be prosecuted.
The indictment marked an extraordinary moment in American history -- the first-ever accusation that a president sought illegally to cling to power. The dismissal also marks a historic moment. Fifty years after Richard Nixon was forced by lawmakers from both parties to resign the presidency amid allegations of criminal conduct, half of American voters will return Trump to the presidency despite his own serious charges of criminal misconduct in office.
"The Government's position on the merits of the defendant's prosecution has not changed. But the circumstances have," Smith's office wrote in Monday's filing, adding that it is seeking to dismiss the charges ahead of Trump's inauguration, in line with the Justice Department's longstanding position that it can't charge a sitting president. "That prohibition is categorical and does not turn on the gravity of the crimes charged, the strength of the Government's proof, or the merits of the prosecution, which the Government stands fully behind," the special counsel added.

WASHINGTON -- Special counsel Jack Smith has filed a motion to drop all four felony charges against President-elect Donald Trump in connection with his effort to overturn his 2020 presidential election in the lead-up to the deadly Jan. 6 attack on the U.S Capitol.
Trump was first indicted on four felonies in August 2023: conspiracy to defraud the United States, conspiracy to obstruct an official proceeding, obstruction of and attempt to obstruct an official proceeding and conspiracy against rights.
The Supreme Court handed Trump an early victory in the case in July with its ruling on presidential immunity. But a new federal grand jury indicted Trump on the same four charges again in August, alleging that Trump's false claims about mass voter fraud during the 2020 election were "unsupported, objectively unreasonable, and ever-changing" and that Trump "knew that they were false." Publicly, Trump has never conceded that his election claims were, in fact, false, and he pleaded not guilty in the case.

(166 posts)So why is anyone surprised? This is the major reason why trump ran and cheated to get elected. This is the (in my opinion) the only reason he ran. To avoid prison. Thats it . He does not want to be president for the true patriotic reason, for love of country and honoring our troops. He didnt want to be the orange jumpsuit # 437896 in Leavenworth Penitentiary ..PERIOD

(12,386 posts)I'm sure that avoiding prison was his primary reason for running, but he'll sure as hell take advantage of the circumstances to enrich himself and take revenge on those who attempted to prosecute him.

(2,796 posts)If anything good comes out of this, it will be the awakening of a lot of people as to what Trump and his MAGAs really are, firsthand. The American people are complacent, uninformed or brainwashed. If Trump and his fascist do what they say they are going to do, that may change significantly. Whether we will still be able to do something about it and get him out remains to be seen.

(3,219 posts)Smith is doing what he can to preserve the case by asking for dismissal without prejudice. The clock on statute of limitations will be on hold while Cantaloupe Caligula the Corpulent is pResident. As long as Caligula doesnt try a self-pardon, the government can go after him in 29.
The person who is responsible for us being at this point is Merrick Garland. He should have been running an investigation from Day 1. Instead, he dicked around until the J6 Committee dumped all their evidence in his lap, and forced Garland into action. By that point, more than a year and a half had gone by, and there was another 6 months or so before Garland appointed Smith (and his ability to get started as he was still in Europe working for the ICC). So it was almost two years after the fact before Smith got going. Then, we all should have expected Caligula to pull the legal stunts he and his lawyers did; dragging out cases is how he fucked over contractors who would sue him for breach of contract and/or non payment. They simply didnt have the money to keep lawyers after him.
So, yeah. Be angry. But lets be angry with the right person.
ETA: Oh yeah, I forgot to include Roberts and his five, corrupt companions. They dragged out hearing the case and rendering a decision, when they should have left it the fuck alone, instead of making up shit.

(35,272 posts)Trump faces four counts related to conspiring to obstruct the 2020 election results. Smiths filing acknowledges that the Justice Department has longed believed a sitting president cannot stand trial, and says prosecutors conferred with Trumps attorneys and that they did not oppose the request to dismiss the case.
That prohibition is categorical and does not turn on the gravity of the crimes charged, the strength of the Governments proof, or the merits of the prosecution, which the Government stands fully behind, the filing states. Based on the Departments interpretation of the Constitution, the Government moves for dismissal without prejudice of the superseding indictment.

SF Giants owner pours cash into Republicans like never before
According to Federal Election Commission filing data, Johnson has made 43 donations totaling $2,862,720.00 since Jan. 1 this year his largest single-year cumulative tally of political donations.
Other than single $5,000 donations to MLBs political action committee and the Franklin Templeton PAC, Johnsons donations were given directly to Republican candidates or organizations. No individual candidate received more direct financial backing from Johnson than Pennsylvania Republican Senate candidate Dave McCormick. McCormicks Keystone Renewal PAC has received $1,000,000 (two $500,000 donations) from Johnson in 2024.
...
This year, Johnson also donated $1,000,000 to the Republicans Congressional Leadership Fund and $250,000 to Grow The Majority, a pair of PACs focused on ensuring Republican control of Congress.
