Special counsel Jack Smith filed motions to drop all federal charges against President-elect Donald Trump regarding his mishandling of classified documents and his effort to overturn his 2020 presidential election in the lead-up to the deadly Jan. 6 attack on the U.S Capitol.

Trump was first indicted in June 2023 in a federal court in Miami on 37 felony counts related to mishandling classified documents that he took from the White House to his Florida home. They included willful retention of national defense information, making false statements, and conspiracy to obstruct justice. A Florida judge dismissed the case, but Smith’s office had sought an appeal.

Trump was separately indicted on four felonies in August 2023 for his attempt to reverse the 2020 election results: conspiracy to defraud the United States, conspiracy to obstruct an official proceeding, obstruction of and attempt to obstruct an official proceeding and conspiracy against rights. The case was then put on hold for months as Trump’s team argued that the case should be thrown out for multiple reasons, including that a former president cannot be prosecuted for his actions in office.

Trump has claimed that the prosecutions were politically motivated. He has never publicly conceded that his election claims were, in fact, false, and he pleaded not guilty in both federal cases. The federal indictments of Trump marked an extraordinary moment in American history — the first-ever accusation that a president sought illegally to cling to power, mishandled classified information and attempted to obstruct a federal investigation. Their dismissal also marks a historic moment. Fifty years after lawmakers from both parties forced Richard Nixon to resign the presidency amid allegations of criminal conduct in office, half of American voters chose to return Trump to the presidency.

"That prohibition is categorical and does not turn on the gravity of the crimes charged, the strength of the Government's proof, or the merits of the prosecution, which the Government stands fully behind," the special counsel added.

The Supreme Court handed Trump an early victory in the case in July with its ruling on presidential immunity. But a new federal grand jury indicted Trump on the same four charges again in August, alleging that Trump's false claims about mass voter fraud during the 2020 election were "unsupported, objectively unreasonable, and ever-changing" and that Trump "knew that they were false." Publicly, Trump has never conceded that his election claims were, in fact, false, and he pleaded not guilty in the case.

If anything good comes out of this, it will be the awakening of a lot of people as to what Trump and his MAGAs really are, firsthand. The American people are complacent, uninformed or brainwashed. If Trump and his fascist do what they say they are going to do, that may change significantly. Whether we will still be able to do something about it and get him out remains to be seen.

Smith is doing what he can to preserve the case by asking for dismissal without prejudice. The clock on statute of limitations will be on hold while Cantaloupe Caligula the Corpulent is pResident. As long as Caligula doesn’t try a self-pardon, the government can go after him in ‘29.

The person who is responsible for us being at this point is Merrick Garland. He should have been running an investigation from Day 1. Instead, he dicked around until the J6 Committee dumped all their evidence in his lap, and forced Garland into action. By that point, more than a year and a half had gone by, and there was another 6 months or so before Garland appointed Smith (and his ability to get started as he was still in Europe working for the ICC). So it was almost two years after the fact before Smith got going. Then, we all should have expected Caligula to pull the legal stunts he and his lawyers did; dragging out cases is how he fucked over contractors who would sue him for breach of contract and/or non payment. They simply didn’t have the money to keep lawyers after him.

So, yeah. Be angry. But let’s be angry with the right person.

ETA: Oh yeah, I forgot to include Roberts and his five, corrupt companions. They dragged out hearing the case and rendering a decision, when they should have left it the fuck alone, instead of making up shit.

Trump has issued so many threats and I believe he meant those threats. By dropping charges Jack Smith is probably making things easier for him going forward. Trump will have less incentive to go after him and try to throw him in jail. Just my opinion.

that a president can do to block someone like Trump. But I think that whatever President Biden can do, he is doing quietly. When you are laying land mines for the enemy you don't advertise where those land mines are placed. Remember it took the Biden administration months to get rid of as many Trump apparatchiks as they could.
