Republicans Vow to Defy Schumer, Escort Dave McCormick Into Capitol

Republican lawmakers are vowing to "escort" Dave McCormick into the Capitol to take part in Senate orientation if the upper chamber's majority leader, Chuck Schumer, continues to withhold his invitation. Senators Mike Lee of Utah, Katie Britt of Alabama and Eric Schmitt of Missouri said they will defy Schumer and personally transport the Republican candidate for the Pennsylvania Senate seat to the ceremony.

The Associated Press called the race between McCormick and Democratic incumbent Senator Bob Casey in favor of the Republican on November 7. Website Decision Desk HQ has still not called the race at time of writing, with Casey's campaign stating he will not concede until all the votes are counted.

Schumer has not invited McCormick to attend Senate orientation in the coming week as there are ballots left to be counted in Pennsylvania. "With over 100,000 ballots left to be counted in Pennsylvania, the race has not been decided. As is custom, we will invite the winner once the votes are counted," a Schumer spokesperson told Fox News Digital on Sunday.

As of early Monday morning ET, McCormick is ahead of Casey by 49 percent to 48.4 percent, amounting to a gap of around 39,000 votes with 99 percent of ballots counted. If the gap is within or equal to 0.5 percent, it would trigger an automatic recount under state law. Any statewide automatic recount must be ordered by the Secretary of the Commonwealth by the end of the second Thursday following an election, which would be November 14.

the vast majority of those ballots are from Philly/Pittsburgh, heavy Democratic. It is a good possibility that Casey can win those ballots 70-30. I have seen experts predict a Casey win.

Philly has 684,729 votes so far, with 92.8% in. That leaves 49,300 left there. The vast majority of remaining counties, McCormick is leading. I know that you're a good person and always think positive, but it doesn't look good.

I know that there's more McCormick counties, but most of them are a lot smaller in size. I'm too tired to try to combine the numbers for all of them, but the latest count has the difference at less than 35,000 votes at 0.51%. The automatic recount kicks in at 0.5% so if the counting pulls things any more in Casey's direction at all, there will be a recount.

It's the Senate Sergeant-at-Arms.


The sergeant at arms can compel senators to come to the Senate Chamber to establish a quorum and can arrest and detain any person violating Senate rules. The sergeant at arms also is responsible for issuing subpoenas at the direction of the president of the Senate or a committee chairman.


And yes, Schumer can have the Senate's Sergeant-at-Arms refuse entry and even detain the unruly Republicans who resist him.

role, but are still breaking abusing their role, defying the majority leader, and engaging in a kind of disorderly conduct, bringing dishonor upon the Senate. Their histrionics have ill intent to fight the Majority Speaker. It's as if they don't GAF about their jobs.

Even worse, they want to publicly "call" the race in PA -- symbolically or actually -- before the PA election votes are counted, which is almost a form of election interference, though they'd insist on some "likely story" that they're only protesting the election process in PA.

Over the last 25 years, the largest vote shift resulting from a statewide recount is .08%

The average is .03% and is more likely to be in the initial leader’s favor

McCormick hasn't won the seat yet. AP doesn't decide who won, Pa election officials decide and they are still counting votes.

What matters is if he's there after January 3rd when the new Senate is sworn in. Is it relevant to the ultimate result whether he is allowed to tour around during the orientation or not?

Why should Schumer bother to make a scene with the Sergeant at arms when McCormick might be there in the end anyway? The Republicans will do bring your kid to work day, but it will be up to Pennsylvania whether he gets to stay.

Zero respect for democracy. None. They've been wearing this as a badge of pride for over a decade now, and it's been normalized ever since they stole a Supreme Court position with no consequences. This is what happens when there are never, ever any actual consequences for your actions. It does not--and will not--end.

If the difference between the candidates is < 0.5%, the recount is mandatory. If Pennsylvania determines that Casey has won, the fact that McCormick was "shown around" the Senate couldn't influence the result, right? It's just about trying to rile up the outrage of their base, like everything else.

The result will be what it is either way.

but there is no guarantee there will be mid-terms. It is a very plausible scenario for there to be an "uprising, attack" etc. used for an excuse for a martial law declaration under the scenario the USSC cited in Milligan v United States during the time of Lincoln. According to the Court " The President can declare martial law when circumstances warrant it:
When the civil authority cannot operate, then martial law is not only
constitutional, but would be necessary: “If, in foreign invasion or civil war, the courts are actually closed, and it is impossible to administer criminal justice according to law, then, on the theatre of active military operations, where war really prevails, there is a necessity to furnish a substitute for the civil authority, thus overthrown, to preserve the safety of the army and society; and as no power is left but the military, it is allowed to govern by martial rule until the laws can have their free course. As necessity creates the rule, so it limits its duration; for, if this government is continued after the courts are reinstated, it is a gross usurpation of power. Martial rule can never exist where the courts are open, and in the proper and unobstructed exercise of their jurisdiction. It is also confined to the locality of actual war.”

Once they would declare the courts to not be viable to function all bets are off. Anybody could argue impropriety all they want but there will be no legal forum to address it. Of course that would be something extreme but I would remind everyone that when Nixon was having his showdown with the Supreme Court over tapes, lost the decision and conducted the Saturday Night Massacre the country held it's breath because we didn't know how far Nixon would go and would he make a move on the SC itself? It was not a question we had assurance about from the military and our overriding question was "who would stop him and how"? Especially if he had some loyalists in the military go to the White House to protect him while others spoke for his removal? These scenarios may seem extreme, and they are to a very real extent, but we are dealing with extremists who have clearly demonstrated they view laws etc. as something to ignore or bowl over.

My point here being it is not a sure thing. How likely will he declare some "uprising" or "invasion"? That might be a whole other matter. Other legal scholars feel that only the Congress could do this and although that may be where would you go to make your legal argument once he declares the Courts closed? Where does an impeachment and conviction go for enforcement if there is no mechanism to enforce it? Do you go to the military? What happens in the case where some in the military support him? Do we end up in a shooting scenario between factions?

At the end of the day we as Americans have always felt that we would always have a "next time". It's in our piece of paper and in our beliefs and our faith in our system. But we are now dealing with people who don't care what the piece of paper says, our beliefs and in fact they use destruction of our faith in our system as a way to further solidify their moves.
