Woman fired from Indiana university over Charlie Kirk post wins $225,000 settlement

A woman fired by an Indiana university over her Facebook post criticizing far-right commentator Charlie Kirk after he was killed will receive $225,000 to settle a lawsuit that accused her former employer of violating her free speech rights, the woman’s attorneys said on Tuesday.

The American Civil Liberties Union announced the settlement in a federal lawsuit it filed last year on behalf of Suzanne Swierc against the Ball State University president, Geoffrey Mearns.

Swierc worked as director of health promotion and advocacy at Ball State’s campus in Muncie, Indiana, before she was fired last September. Ball State cited Swierc’s private Facebook post about Kirk as the sole reason for her termination, saying it caused “significant disruption” to the campus.

Swierc’s firing violated her constitutional rights because she was “speaking as a private citizen on a matter of public concern”, said Stevie Pactor, an ACLU attorney in Indiana.

Needless to say, she (and I) were extremely upset. The weasely admin caved to threats from the state Attorney General and Lt Governor when they threatened a take-over similar to what they executed at Indiana University if she weren't fired.

The President tried to calm faculty and staff by assuring them they they would "vigorously defend" the suit and that "they would reveal their evidence at trial." This was widely interpreted as meaning they had jack shit. Mearns (the President) was also sued personally in his capacity as President since he said the firing was his decision. He settled first, and while his settlement has been kept quiet, the word is that it was 6-figures as well. In other words, students and taxpayers get screwed to placate our psychotic state government.

This is GREAT news.

... donated a lot. The Letterman Communications Building is named for him.

This year, the actor Hugh Jackman visited 6 times or so, and gave the commencment address. His current partner was a visiting professor in the Theater and Dance Deprtment. He was very generous with his time and visited with the students in the both the Student Center and the Atrium (food court in the Arts and Journalism Building) for hours, signing autographs and taking selfies.

My wife is a Professor here and my daughter is a Senior.

It's a great school in a state with really crappy and evil leadership. Thanks fpr ypur note!

Congratulations in advance to your daughter! Please thank your wife for her work as an educator. I owe most all the good in my life to Wayne State University in Detroit.

My sister was born in Bloomington. My father was in the US Navy, stationed at then-Crane Naval Ammunition Depot. Years later, we moved to St. Joseph, Michigan, just north of South Bend; and attended the now-closed Howe Military School in the early 1970s. My classmates included Sen. Birch Bayh's sons, one of whom became governor and a US senator. All the cadets respected their "fighting spirit." We also knew their mom and dad helped keep Teddy Kennedy alive after surviving a June 1964 plane crash that killed two people.

I especially remember one truly remarkable cadet -- outstanding academically, athletically, morally and spiritually. His brother, John Putz, was a US Marine who died a few weeks after arriving in Vietnam. "Friendly fire" from an "accidental discharge." His family was never the same. Both parents passed while their son was still in high school. While I lost touch with him, his brother, I understand, went on to a career in the US Army.

Truly great people from Indiana. I think the GOP does well because SCOTUS equated money with freedom of speech, giving the rich all the edge they really need with the game set up the way it is.

The assholes responsible should have to pay the extra if premiums go up because of this, or just pay the settlement themselves.

In her Facebook post, Swierc referred to Kirk’s killing as a “tragedy”. But she also called it a “reflection of the violence, fear, and hatred he sowed”. She wrote: “If you think Charlie Kirk was a wonderful person, we can’t be friends.”

and just use it for "I get to say what I want to, anywhere, but you don't, if you disagree with me". I think they have been brainwashed by Trump into thinking that he now owns the USA, and so gets to set any rule about what people can do.

This is the second such settlement that has ended well. Hopefully, more people who fired for simply saying that ck was a jerk, based on his own words, will also either file lawsuits or get settlements if they are already in court.
