Instead, the threat that had House Republicans all riled up is the idea of increasing the number of justices on the Court. On its website, the Judiciary Committee promised during the hearing to examine the history and perils of court packing, as well as other policy proposals that threaten to undermine the integrity of the judicial branch.
Throughout the morning, Republicans framed their resistance to Court expansion as a defense of the institutions legitimacy. The GOPs first witness, Missouri Solicitor General Louis Capozzi, claimed that expansion would undermine the Courts insulation from partisan politics, which enables it to make decisions based on what the law requires, and not the fleeting goals of political actors. The second witness, Cumberland School of Law professor William Ross, claimed that expansion would let the elected branches manipulate the outcome of judicial decisions by appointing justices who would be expected to conform to the political predilections of the president.
The third witness, a law firm partner named Gene Schaerr, claimed that expansion proposals distract from the more important work of building political and legislative coalitions. Schaerr further suggested that people who dont like the Courts interpretation of the Voting Rights Act should simply ask the Republican-controlled Congress to amend the statute.

(14,659 posts)Just because we have 9 justices now doesn't mean we always did, or always should. If the G00Pers would even LOOK at their history books, they would know that there is no specified number of justices on the Supreme Court, nor has there ever BEEN any specified number. Furthermore, there haven't even always BEEN 9 justices.
Secondly, they can stop ranting about the SC being "politicized", because it's never been as political or politicized as it is right this moment. You cannot tell me that the Roberts court as it is now composed is anything BUT a RepubliKKKan rubber stamp! So STFU and get over yourselves, Repugs. As soon as we get control again, some things are about to change.

Instead:
They were all walking down the jungle path, swatting at mosquitoes, completely oblivious to the herd of charging elephants........

(7,206 posts)if they believed Trump was the existential threat to democracy and that was more of a real belief than a campaign slogan, they'd have done it in a heartbeat, and then made sure at least one of the liberal justices they picked was committed to lifting Trump's indictments out of the hands of foot draggers and used the Presidential power they had to blow out Trump's objections and delays, try him and jail his ass.. The fact that this did not happen did a lot of damage to the Democrats among their own constituents. Now the fight is harder, longer and costlier, and this is the result of partisan politics.
So I vote for those who show that they're willing to take risks and be bold about opposing this enemy of America.

(234 posts)For 25 years now the GOP SCOTUS majority has acted like highly partisan political hacks doing the GOP's dirty work at every turn. This nightmare started with the unconstitutional 2000 Bush vs Gore ruling that stopped the legal Florida vote count and has now culminated in the overturning of the 1965 Voting Rights Act which the former slave states are now using to restore the Confederacy.
Article 3, Section 2 of the U.S. constitution gives Congress the authority to regulate the SCOTUS. Congress. Congress needs to use this authority to take voting cases away from the highly partisan GOP SCOTUS majority and give them to a non-partisan independent commission to rule on.
The GOP SCOTUS majority's highly-partisan rulings that clearly favor republicans has destroyed the SCOTUS legitimacy.
