because too many of their rulings ignore the Constitution.
There is the Constitution and what it says, and what this Court does, they rarely are the same.

(38,252 posts)But I suspect the ruling will hinge on state control of elections (state elections clause) not on the fifteenth amendment. If it is based on the 15th amendment, they would have to do a careful tapdance to get around their own recent (conservative) decision eliminating federal oversight of voting rights in states with a history of civil rights discrimination.

(1,461 posts)The U. S. constitution very clearly gives the states the legal authority to conduct elections. This is why the repug Rehnquist 5's Bush vs Gore ruling is unconstitutional. It took away Florida's right to conduct an election and count all of the uncounted votes. This is how we got tRump.
